Data Privacy, National Security, and the FCC

Although the United States does not have a comprehensive federal privacy law, Congress has passed several sector-specific privacy statutes to protect Americans’ personal information. Did you know that the FCC is one of the few federal regulators with express statutory authority to address data privacy issues? Did you also know the Communications Act directs the FCC to regulate the nation’s communications infrastructure under a core enumerated purpose to protect the national defense? The FCC’s Enforcement Bureau continues to prioritize data privacy cases while increasing its focus on addressing national security risks through enforcement actions.
